Defense inside limits (also called eroding limits or burning limits) means defense costs reduce the total policy limit available to pay a judgment or settlement. Defense outside limits means the insurer pays defense costs separately, preserving the full policy limit for indemnity payments. Firms in litigation-heavy or high-stakes practice areas should seriously consider defense outside limits or at minimum purchase higher inside-limits policies to account for potential erosion.
